Abstract: Since an individual lives in society with other individuals, the exercise by him of his rights must necessarily be regulated, and restricted to the extent necessary, to enable others to exercise their rights. The permissible restrictions on the exercise of rights must be distinguished from the power of the state to derogate from some of its obligations in time of public emergency. While a restriction prescribed by law may remain in force indefinitely, derogation is essentially a temporary measure limited to the period of ‘the public emergency threatening the life of the nation’.
