Title: A Virtuous Profession: Re-Conceptualizing Legal Ethics from a Virtue-Based Moral Philosophy
Abstract: Much of what passes for legal instruction consists of a review of professional codes of conduct and rhetorical debates about hypothetical dilemmas. In this essay, the author argues that legal can neither be taught nor learned without first laying the necessary philosophical foundations and making the requisite choices among ethical models and paradigms. He canvasses and summarizes some of the important philosophical concepts and models -- in particular, the central notions of ethics and profession. The author proposes a departure from the rules versus consequences debate that traditionally characterizes this area and argues that an Aretaic (or virtue-based) ethical theory is the best way to conceptualize legal-professional ethics.
