Abstract: What are the appropriate laws governing the transmission of property at death in the 21st century? This article contrasts the Uniform Probate Code with Vermont Law. The focus is on the substantive laws of inheritance, spousal rights, and wills rather than on provisions governing the probate process itself. Vermont law has not moved far from its 18th century roots and does not meet the needs or expectations of its citizens. The Uniform Probate Code would clarify and improve the law.
