Title: Le droit est aussi une question de visibilité: l'occupation des espaces publics et les parcours judiciaires des personnes itinérantes à Montréal et à Ottawa
Abstract: Résumé En se fondant sur une enquête de terrain effectuée à Montréal et à Ottawa de 2005 à 2009 auprès de personnes itinérantes judiciarisées et d'acteurs œuvrant à différents niveaux dans le processus de pénalisation et de judiciarisation, cet article propose une analyse des stratégies de contrôle dont les personnes itinérantes font l'objet, ainsi que de leurs parcours judiciaires pour des infractions pénales liées à leur utilisation des espaces publics. Les auteurs suggèrent que la question de la visibilité ou de l'invisibilité des personnes itinérantes est au cœur des tensions que vivent les personnes itinérantes dans leur rapport au système pénal. Alors que leur visibilité dans les espaces publics contribue à leur identification et à leur profilage sur la base de caractéristiques sociales, lorsqu'elles se retrouvent prises en charge par le système judiciaire, c'est plutôt leur invisibilité qui porte atteinte à leurs droits les plus fondamentaux et entrave leur accès à la justice.
