Title: Enforcing the right not to be refused emergency medical treatment : towards appropriate relief
Abstract: Hierdie artikel bespreek die afdwinging van die grondwetlike reg om nie mediese noodbehandeling geweier te word nie. Daar word geargumenteer dat die Grondwetlike Hof se algemene benadering tot die uitleg van sosio-ekonomiese regte (ingevolge waarvan sodanige regte tipies nie individueel-afdwingbare voordele inhou nie) nie die moontlikheid van 'n effektiewe, individuele remedie in geval van 'n skending van die reg op noodbehandeling uitskakel nie. Die artikel plaas die reg (wat in artikel 27(3) van die Grondwet verskans word) in die tekstuele en remediA«rende konteks van die Handves van Menseregte en stel 'n belang-gefokusde uitleg van die reg voor, wat aandui dat daar verskeie moontlike remedies vir onregmatige inbreukmaking op die reg bestaan. Vervolgens word die Grondwetlike Hof se uitleg van die onderhawige reg in Soobramoney v Minister of Health KwaZulu Natal krities bespreek, waarna oor die indirekte (vertikale en horisontale) afdwinging van die reg deur middel van die ontwikkeling van die gemenereg (en spesifiek die deliktereg) besin word. Die artikel kom tot die slotsom dat onregmatige inbreukmaking op die reg om nie noodbehandeling geweier te word nie uiteraard in sekere omstandighede as direk en individueel remedieA«rbaar beskou behoort te word.
