Abstract: Dr. Petersen has set out to explain what he sees as the limited domain of rationalchoice explanations of international law (Petersen [2009]). His matrix associates rational choice with traditional customary international law, finding rational choice sufficient to explain this area of law. However, he finds that rational choice is insufficient to explain two important areas of international law: human rights and goods, meaning by public goods environmental protection. For these areas, he proposes that discourse analysis, focusing on principles, rather than rational choice, focusing on rules, is the appropriate tool of analysis.
