The legal basis for juvenile criminal responsibility is stipulated by Article 17 of the Criminal Law of China. The chapter reviews the nature and scope of juvenile delinquency in post-revolutionary China. The chapter then elaborates on the development of legislation on juvenile justice in China, focusing on the two important national laws. The Chinese model of delinquency control is quite different from Western models in its intentions and values. This is also true in terms of reforming juvenile delinquents. On the basis of the two legislations on juvenile justice in China, a three-stage hierarchy of juvenile delinquent reformation can be identified: educational assistance programs; work-study schools; and juvenile reformatories.
