Title: ACES & BOATS AS THE POPULARITY OF CRUISE SHIP GAMBLING SOARS, WHY DO THE AIRLINES REMAIN GROUNDED
Abstract: This article examines the sharp distinction in federal law which permits regulated gaming on all types of nautical vessels yet denies similar privileges to the airlines. The article reviews the effects of a provision of the Federal Aviation Administration Authorization Act passed in 1994. This provision, known as the Gorton Amendment, prohibits gaming on any flights to or from the United States and applies to foreign and domestic airlines. The article also reviews the history of shipboard gambling and cruise ship casinos. The author concludes that there is substantial justification for granting both foreign and domestic air carriers the right to offer gaming to their passengers on international flights.
