Title: The complexities of freedom of speech and expression in cyberspace in digital India
Abstract: Abstract: This paper is part of the research related to fundamental rights of Indian citizens in cyberspace. It deals with the complexities of use and misuse of Freedom of speech and expression in cyberspace in a growing and developing Digital India scenario. Fundamental Right of Freedom of speech and expression is under great threat due to technology advancement and growing utilisation of electronic and social medias like internet, facebook , blog ,twitter and MMS ( Multi Media Messaging Service) etc under the progressing Digital India program. Article 19 of Indian constitution guarantees freedom of speech and expression but with certain permissible restrictions . United Nations has declared freedom of speech and expression in cyberspace as part of basic human rights. Supreme Court of India has upheld the guaranteed freedom of speech and expression but with the right of the State to put reasonable restrictions under certain circumstances. Freedom of speech cannot be at the cost of another person’s reputation or causing defamation to someone. The recent emergence of cyberspace with all it’s global complexities has compounded the scope of right of freedom of speech on internet which also represents other electronic social medias. There is no publicly and globally acceptable solution to ensure acceptable use and against misuse of freedom of speech on internet due to it’s complex nature.
