Abstract: Intellectual property rights belong to private right, and our Constitution provides protection for citizens’ private property. So it is vital to make clear the status of intellectual property rights in the constitution. Intellectual property rights protect citizens of free creation and the interests of spirit and material. And some certain intellectual property rights even relate to survive and development of some colony. Besides, the system of intellectual property rights is developed in the adjustment between public and creators private interests. In the era of knowledge economy, intellectual property strategy has become the foundation and an important component of our national policy. Once this strategy comes into being, it should be added to the Constitution.
